Analysing a claim for loss of earnings
Professional opinion in a medical negligence claim
Our client was the defendant in a medical negligence claim.
Our client had been sued following an unsuccessful operation on a high profile football agent which led to restrictions on the amount that the agent could work.
The challenge
The claim was for loss of profits based on the agent’s inability to work. As an agent, complexities arose in this case as analysis was needed, not just of the agent’s earnings, but also those of their footballing client base and the future deals that the agent may have been part of. Our expertise acting for professional footballers coupled with our forensic experience was called upon in this case.
How did the Firm help?
We prepared a report that commented on the claim for loss of earnings. We analysed the agent’s potential earnings in depth and provided a professional opinion on the claims made. This enabled our client to present a counter case to the agent.
The outcome
We analysed the agent’s potential earnings in depth and provided a professional opinion on the claims made. This enabled our client to present a counter case to the agent.
There was a negotiated settlement out of court which saved any reputational damage for both parties and financially was a favourable outcome for both parties.
