Our Global Mobility seminar on July 11 provided an update concerning the latest IR35 regulations.
In April 2021, the Government updated the IR35 regulations meaning private sector firms who enter into contracts or make payments to workers engaged through an intermediary on or after 6 April 2021 will need to check the individual’s ‘deemed employment’ status. In other words, IR35 considers whether the worker would be regarded as an employee of the client if the worker was not engaging through an intermediary.
There are significant practical challenges associated with these changes, including how to onboard PSCs on to PAYE and any interaction with VAT, how to compute the deemed employment payment, how to handle disputes raised by contractors and interactions with other similar rules such as the agency worker legislation.
